ARKA Fiber Terms Conditions

These Terms & Conditions (“Terms”) govern your use of ARKA Fiber’s website, forms,
phone numbers, text messages, emails, scheduling tools, customer support
communications, and related services (collectively, the “Services”).
By using our Services, submitting information to us, communicating with us, or
scheduling an appointment through us, you agree to these Terms.
1. About ARKA Fiber
ARKA Fiber (“ARKA,” “we,” “our,” or “us”) provides sales, scheduling, rescheduling,
customer coordination, installation support, and related services for internet service
providers, installation partners, and customers.
Unless expressly stated otherwise, ARKA Fiber is not the internet service provider,
utility, carrier, or owner/operator of the internet network. Internet service availability,
pricing, installation eligibility, service speeds, equipment, billing, account approval, and
final service activation may be controlled by the applicable internet service provider or
other third-party partner.
2. Use of Our Services
You agree to use our Services only for lawful purposes and in a way that does not
interfere with our operations, systems, employees, contractors, customers, partners, or
third-party providers.
You agree not to:
Provide false, inaccurate, or misleading information.
Use our Services for fraudulent, abusive, harassing, unlawful, or unauthorized
purposes.
Attempt to access systems, data, accounts, or information that you are not
authorized to access.
Interfere with or disrupt our website, phone systems, CRM systems, scheduling
tools, or other technology.
Impersonate another person or misrepresent your authority to act on behalf of
another person.
3. Customer Information
You agree that the information you provide to us is accurate and current. This may
include your name, service address, phone number, email address, appointment
information, and other information needed to schedule, reschedule, confirm, or support
an internet installation or service request.
You authorize us to use and share your information as reasonably necessary to provide
the Services, coordinate with internet service providers and installation partners,
support appointment scheduling, provide customer service, and operate our business,
as further described in our Privacy Policy.
4. Calls, Text Messages, and Emails
By providing your phone number or email address, you authorize ARKA Fiber and its
representatives, contractors, service providers, and partners to contact you regarding
your appointment, installation, order, service request, customer support matter, or
related services.
Communications may include phone calls, text messages, voicemail messages, and
emails. Standard message and data rates may apply.
Some calls may be monitored or recorded for quality assurance, training, compliance,
and business recordkeeping purposes.
You may request that we stop sending certain communications. However, we may still
contact you for non-marketing or transactional purposes, including appointment
confirmation, appointment rescheduling, installation coordination, customer service, or
legally required communications.
5. Appointment Scheduling and Installation
ARKA Fiber may help schedule, confirm, cancel, or reschedule installation
appointments. Appointment dates and times are not guaranteed unless confirmed by
the applicable internet service provider, installation partner, or authorized
representative.
Installation may be subject to:
Service availability at your address.
ISP approval or account verification.
Property access.
Landlord, HOA, utility, or municipal requirements.
Equipment availability.
Weather, technician availability, construction conditions, or other operational
factors.
Final approval by the applicable internet service provider or installation partner.
ARKA Fiber is not responsible for delays, cancellations, unsuccessful installations,
service denials, service interruptions, speed limitations, billing disputes, equipment
issues, or other matters controlled by a third-party internet service provider, installation
company, utility, property owner, or other third party.
6. Internet Service, Pricing, and Third-Party Providers
Internet service plans, pricing, promotions, fees, taxes, equipment charges, speeds,
terms, service availability, billing, and cancellation rules are determined by the
applicable internet service provider or third-party partner.
Any information we provide about pricing, promotions, service plans, speeds,
installation, or availability is based on information available to us at the time and may be
subject to change, verification, eligibility requirements, or final approval by the
applicable provider.
You are responsible for reviewing and accepting any separate terms, service
agreements, disclosures, pricing documents, broadband labels, billing terms, or other
conditions provided by the applicable internet service provider or third-party partner.
7. Third-Party Services and Links
Our Services may include links, references, integrations, or referrals to third-party
websites, platforms, internet service providers, installation companies, payment
processors, CRM systems, or other service providers.
We are not responsible for third-party websites, systems, services, terms, privacy
practices, security, availability, pricing, billing, or performance. Your use of third-party
services is governed by the terms and policies of those third parties.
8. No Guarantee of Service Availability or Performance
ARKA Fiber does not guarantee that internet service will be available at your address,
that you will qualify for a specific service plan, that installation will occur on a specific
date, that service will be activated, or that any internet service will achieve a particular
speed, uptime, reliability, or performance level.
Any service speed, performance, uptime, installation, or network-related representations
are the responsibility of the applicable internet service provider unless ARKA Fiber
expressly states otherwise in a written agreement signed by an authorized
representative.
9. Website Content and Accuracy
We try to keep information accurate and current, but we do not guarantee that all
website content, service descriptions, availability information, pricing information,
promotions, or other materials are complete, current, or error-free.
We may update, modify, suspend, or remove content or Services at any time without
notice.
10. Intellectual Property
All content on our website and in our materials, including text, graphics, logos, designs,
forms, documents, and other materials, is owned by ARKA Fiber or used with
permission, unless otherwise stated.
You may not copy, reproduce, modify, distribute, sell, or exploit our content without our
prior written permission, except for personal, non-commercial use related to your
interaction with our Services.

incidental, consequential, special, exemplary, or punitive damages, including lost profits,
lost revenue, lost data, loss of service, loss of business opportunity, or damages arising
from delays, cancellations, failed installations, service interruptions, billing disputes,
provider decisions, or third-party conduct.
To the fullest extent permitted by law, ARKA Fiber’s total liability for any claim arising out
of or relating to the Services will not exceed the amount you paid directly to ARKA Fiber
for the specific Service giving rise to the claim, or $100, whichever is greater.
14. Indemnification
You agree to defend, indemnify, and hold harmless ARKA Fiber and its owners, officers,
employees, contractors, representatives, vendors, and partners from and against any
claims, damages, losses, liabilities, costs, and expenses, including reasonable
attorneys’ fees, arising from your misuse of the Services, violation of these Terms,
violation of law, or submission of false, inaccurate, or unauthorized information.
15. Changes to These Terms
We may update these Terms from time to time. If we make changes, we will update the
effective date above. Your continued use of our Services after updated Terms are
posted or provided means you accept the revised Terms.
16. Governing Law
These Terms are governed by the laws of the State of [State], without regard to conflict
of law principles.
Any dispute arising out of or relating to these Terms or the Services will be handled in
the state or federal courts located in Utah County, UT, unless otherwise required by
applicable law.
